1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of ScheduleSpark ("Service"), operated by ScheduleSpark ("we", "our", "us") at schedulespark.com. By joining our waitlist, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

ScheduleSpark is shift scheduling software that lets site owners build schedules, assign shifts to workers, and notify workers via email or WhatsApp. The Service is currently in early access — features, availability, and pricing may change before general availability.

3. Accounts & Eligibility

You must be at least 18 years old and able to form a binding contract to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Free & Paid Plans

The single-site plan is free. Additional features — including multiple sites, subdomains, and enterprise capabilities such as SSO and dedicated support — may be offered as paid tiers. Pricing and billing terms for paid tiers will be presented and agreed to separately before you are charged.

5. Acceptable Use

  • Do not use the Service for any unlawful purpose or to violate any laws in your jurisdiction
  • Do not attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Do not send unsolicited or abusive communications to workers through the Service
  • Do not interfere with or disrupt the integrity or performance of the Service
  • Do not reverse engineer or attempt to extract the source code of the Service

6. Your Content

You retain ownership of the schedule, worker, and shift data you input into the Service ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to provide and improve the Service, including sending the notifications you configure.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by ScheduleSpark and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets except as necessary to use the Service as intended.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with reasonable notice where practical.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose. During early access, the Service may contain bugs, experience downtime, or change without notice.

10. Limitation of Liability

To the maximum extent permitted by law, ScheduleSpark shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service, including missed shifts or notifications.

11. Changes to These Terms

We may update these Terms as the product evolves. We will notify waitlist subscribers and account holders by email for any material changes. The "Last updated" date above reflects the latest revision, and continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by applicable local law, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
